What is an Estate Plan?

An estate plan is a collection of documents outlining your wishes in the event you die or incapacitated. The documents include, but are not limited to, a will, durable power of attorney, healthcare power of attorney/advance directives, beneficiary designations, and guardian designations. Some of the main purposes for estate planning is to name guardians for your underage children, and to ensure that your assets will be transferred to your designated beneficiaries. Should you die without a will, the probate court will decide who will inherit your properties and possessions.

“A revocable living trust is a legal device that can be used to manage your property during your lifetime and to distribute your property after your death.” (Oregon State Bar) Some people may choose a living trust because it bypasses the probate process.

Need Witnesses?

If your documents require witnesses, please arrange them ahead of time for your notarization appointment. In general, witnesses should not be family members or persons who have any interest or stake in the signing, or healthcare providers. If you cannot find anyone to be witnesses, we can make arrangements for a fee. However, most people ask their neighbors or friends to be their witnesses.

Signer's ID

The signer needs to present his/her government-issued ID with a photo, birthday, and physical descriptions to the notary. The most commonly used IDs are driver’s license and passport. If your ID has been expired, please let us know in advance so that we can check to see if it can be used.

Alert, Coherent, and Aware?

The signer needs to be aware and coherent at the time of signing, and aware of the content of the document and what s/he is signing for. The signer also needs to sign of his/her own free will. We ask the signer some general and specific questions to see if s/he is alert and aware. We ask family members not to answer those questions for him/her. When we cannot confirm that s/he is coherent or signing voluntarily, we may decline notarization.

Can't Sign without assistance?

If the signer cannot sign by him/herself or has a hard time writing, let us know in advance. We can talk about options such as different types of pens, sign by mark, or signature by third party.
