What is a Notary Public?

A Notary Public is a person of proven integrity appointed and commissioned by the Secretary of State to act as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. These official acts are called notarization or notarial acts.

A Notary’s duty is to screen the signers of important documents for their true identity, their willingness to sign, and their awareness of the contents of the document or transaction. For more information about Notary in Oregon, visit the Secretary of State website.

What a Notary Public cannot do

Unlike Notaries in some foreign countries, a US Notary Public is NOT an attorney. – I am not an attorney licensed to practice law. I am not allowed to draft legal records, give advice on legal matters, including immigration, or charge a fee for those activities. (ORS 194.350(4)(A))

Notary, Mobile Notary, Loan Signing Agent

A Notary Public is commissioned by the Secretary of State. A Mobile Notary is a Notary who travels to notarize documents and often offers additional services such as printing and shipping documents. All Mobile Notaries are Notaries, but not all Notaries are Mobile Notaries. A Loan Signing Agent (or Notary Signing Agent / Certified Signing Agent) is a Mobile Notary who has been trained to facilitate the signing of more complicated loan package (often times more than 100 pages). All Loan Signing Agents are Mobile Notaries, but not all Mobile Notaries are Loan Signing Agents. The relationships are like a pyramid. For more information about Loan Signing Agent, visit the National Notary Association website.
